VA Minimum Property Requirements: What Your Agent Must Know

VA Minimum Property Requirements (MPRs) are the VA’s standards for the condition and safety of a property. Unlike conventional loans (where the buyer can waive inspection contingencies), VA loans require the property to meet MPRs or the loan will not close. An agent without VA transaction experience does not know: (1) Which defects will trigger MPR failure: peeling paint (in pre-1978 homes), missing handrails, roof with less than 2 years remaining life, exposed electrical wiring, non-functioning HVAC, water damage evidence, and inadequate access to the property all trigger MPR issues. (2) How to disclose MPR risks to the seller before offer: an experienced VA agent discloses known MPR issues in the offer letter, requesting seller repair credits rather than discovering them at appraisal. (3) The Tidewater Process: when the VA appraiser believes the property’s value will not support the purchase price, they initiate the Tidewater process — providing the agent 48 hours to submit additional comparable sales data. An agent who doesn’t know Tidewater exists cannot respond in 48 hours with data that saves the deal.

VA Entitlement: Basic, Bonus, and Remaining

VA loan entitlement is the amount the VA guarantees to the lender if the borrower defaults. Understanding entitlement determines what you can purchase and whether you need a down payment: (1) Full entitlement: buyers who have never used a VA loan or have had a prior VA loan fully paid off have full entitlement — no loan limit, no down payment required regardless of purchase price. (2) Remaining entitlement: buyers with an active VA loan have remaining entitlement equal to $36,000 + 25% of the conforming loan limit minus the VA’s current guarantee on the prior loan. Purchases above the remaining entitlement require a down payment of 25% of the excess. (3) Entitlement restoration: VA entitlement is restored when a prior VA loan is paid in full AND the VA issues a formal restoration. It is not automatic — the service member must apply. An agent who tells you entitlement restores automatically is wrong. (4) One-time restoration: in specific circumstances, a service member can use VA entitlement a second time without full restoration if the prior VA home is sold. This requires documentation most agents don’t know to gather.
