Florida’s homestead protection from creditors is the strongest in the United States — and for high-net-worth individuals in professions with litigation exposure, it is as important as the income tax advantage. Article X, Section 4 of the Florida Constitution protects the primary homestead from forced sale by creditors with few exceptions. Unlike every other state, Florida places no dollar cap on this protection. A $50 million Palm Beach home is protected as fully as a $200,000 Ocala home.
