On a $100M settlement at 33%: $33M gross, minus expenses advanced, minus co-counsel splits, minus overhead allocation. Net to the lead attorney: varies significantly. (4) The tax year problem: the entire contingency fee is recognized as income in the year of receipt. It is taxed as ordinary income (not capital gains). The tax year of a major settlement shows extraordinary income. The years before and after show minimal income. The 2-year average method produces a wildly inaccurate qualifying number.

The lower loan-to-value reduces lender risk and may qualify for better terms even with non-standard income history. (3) Cash purchase option: the attorney who received a $25M settlement and wants to deploy $4M into real estate may consider a cash purchase: no income documentation required, no DTI calculation, fastest closing timeline. (4) The year-after-settlement timing: if the attorney applies in the year after the major settlement, their most recent tax return shows the full settlement income. This is the single strongest income document available. The prior year with $0 is averaged with the settlement year but the average is still very high. This is the optimal timing window.
