Miami-Dade County adopted a formal ADU ordinance in 2022, one of the more structured frameworks in Florida. Key provisions: (1) ADUs are permitted in single-family residential zones (EU, RU-1, RU-2) on lots meeting minimum size requirements. (2) Maximum ADU size: 1,000 sq ft or 50% of the main dwelling, whichever is smaller. (3) One ADU per lot. (4) The ADU must be subordinate in appearance to the main dwelling (cannot be larger or more prominent). (5) Detached ADUs must meet setback requirements: typically 7.5 ft from side lot lines, 20 ft from the rear lot line. (6) Minimum lot size for a detached ADU: typically 7,500 sq ft in RU-1 zones; larger in EU zones. (7) Short-term rental of ADUs (Airbnb-style) is regulated separately by the municipality within Miami-Dade — check city/municipality rules as well as county rules. Miami-Dade municipalities (City of Miami, Coral Gables, Pinecrest, Coconut Grove) may have more restrictive rules than the county baseline.

Palm Beach County: Palm Beach County’s ADU regulations allow detached accessory dwelling units in most single-family residential zones with specific size and setback requirements. Key: (1) Maximum detached ADU size: 750–1,200 sq ft depending on the zoning district. (2) Setback requirements vary by zoning district and lot size. (3) Some municipalities within Palm Beach County (Town of Palm Beach, Jupiter, Boca Raton) have their own, often more restrictive, ADU rules. The Town of Palm Beach has historically been one of the most restrictive jurisdictions in Florida for secondary structures. Verify at the municipal level before relying on county-level allowances. Collier County (Naples): Collier County’s Land Development Code allows guest houses and ADUs on estate-zoned (E) and residential single-family (RSF) zoned properties. Guest houses are permitted on lots of 1 acre or larger in estate zones. The guest house must be located on the same lot as the principal structure, cannot exceed 45% of the main living area, and must be architecturally compatible with the main house. Collier County is among Florida’s most permissive counties for large-lot estate guest houses.

Pinellas County (St. Petersburg, Clearwater): one of the most actively expanding ADU programs in Florida. The 2023 Pinellas County ADU ordinance allows detached and attached ADUs on all single-family lots regardless of lot size (removing the previous minimum lot size requirement). Maximum ADU size: 50% of the principal structure or 800 sq ft (detached), 1,000 sq ft (attached). This makes Pinellas one of the most ADU-friendly counties in the state for smaller lots. Hillsborough County (Tampa): ADUs permitted in RSC-2, RSC-4, RSC-6, and other residential zones with specific size limits. The City of Tampa has its own ADU ordinance within the county. Maximum detached ADU: 900 sq ft. Setback requirements apply. Orange County (Orlando): ADUs permitted in single-family zones. Maximum ADU size: 1,000 sq ft or 50% of the principal dwelling. Orange County municipalities (City of Orlando, Winter Park, Windermere) have separate, sometimes more restrictive, rules. Windermere, where many luxury golf communities are located, has historically been conservative on secondary structures.

Sarasota County: ADUs and guest houses are permitted in residential zones on lots meeting minimum sizes. Guest houses on estate lots (1+ acres in RSE zones) are generally permitted up to 50% of the main house size. Sarasota City has a separate, more expansive ADU ordinance allowing ADUs on smaller lots. Brevard County (Space Coast): growing ADU-friendly environment. Brevard’s large-lot residential zones in areas like Viera, Rockledge, and Merritt Island accommodate detached guest structures. Brevard is an emerging multigenerational market where large-lot estate properties with buildable guest house potential are available at lower price points than South Florida. Key principle for all Florida counties: the county zoning rules apply to the unincorporated county; properties within a municipality (city or town limits) are governed by the municipality’s zoning code, which may be more or less permissive than the county code. Always confirm zoning at the property-address level through the county or municipal building/zoning department before making any offer that depends on the ability to build or use a secondary structure.
