How to Find Estate Properties

(1) MLS listings: OLH lists estate properties on MLS with clear disclosure that the sale is an estate sale. Search for “estate sale” or “probate” in the listing remarks. (2) Probate court records: probate proceedings are public record in most states. The court inventory lists real property that will be sold during administration. Making Offers That Executors Accept

An executor is a fiduciary who must obtain fair market value. Low-ball offers will not be accepted — an executor who accepts a materially below-market offer risks personal liability to the estate’s heirs. Offers that appeal to executors: (1) At or near BPO value: the BPO establishes the executor’s fair market value baseline. An offer at or above that number is easily defensible. (2) Fast close: every day the estate carries the property is an expense. A 21–30 day close is worth more to an executor than a 60-day close at a slightly higher price. (3) As-is acceptance: no repair requests, no seller credits. Executors cannot make repairs and cannot provide seller credits from the estate without court approval in many states. (4) Proof of funds: cash buyers or buyers with committed financing are strongly preferred. Financing contingencies create uncertainty the executor cannot easily manage.

Estate Sales vs. Conventional Sales: Key Differences

(1) As-is condition: estate properties are sold as-is. The executor typically does not have personal knowledge of the property’s condition and cannot make the representations a conventional seller makes. Conduct all inspections during the contingency period. (2) Court confirmation (in some states): in California full probate sales and some other states, an accepted offer is subject to court confirmation with overbidding. Are estate sale properties sold below market value?

Sometimes, but not always. The executor’s fiduciary duty requires fair market value. Discounts may exist because the property is sold as-is, the executor is motivated to close quickly, or the property needs deferred maintenance. These are real discounts, but they are priced into the market, not secretly available. OLH’s BPO establishes fair market value for each estate property.

Can my offer be outbid after it's accepted in a probate sale?

In California full probate sales and some other states, yes. Court confirmation allows overbidding at the hearing. The overbid must typically exceed the accepted offer by a minimum amount (often $500–$5,000 or a percentage). Budget your offer assuming overbid competition is possible in confirmation states.

Does OLH represent buyers in estate sales?

No. OLH represents the estate as the seller. Buyers who want representation should engage their own buyer’s agent or attorney. OLH’s obligation in every estate engagement is to the executor and the estate’s heirs collectively, not to any individual buyer.
