The Five Readiness Dimensions for Divorce Real Estate

Dimension 1 — Profile identification: Are you the seller (needing to sell the marital home by agreement or court order), the buyout spouse (wanting to keep the home), or the purchasing spouse (buying a new home after divorce)? Each profile has different first steps, different specialists, and different qualification considerations. Dimension 2 — Financial and qualification picture: For sellers — estimated equity and expected proceeds. For buyout spouses — can you qualify for the refinance on one income? Dimension 3 — Legal stage and constraints: Has the divorce been filed? Is there a temporary order affecting the home? Is there a final decree with a sale deadline? Is there a lis pendens? Custody geography restriction? Dimension 4 — Timeline and urgency: Is there a court-ordered deadline? Is the carrying cost of the joint mortgage creating financial pressure? Dimension 5 — Price tier and market: What is the estimated home value? What market?

Seller Readiness: What Makes You Ready

A divorcing seller is ready to proceed when: (1) both parties' attorneys have been briefed on the listing plan and have no current objection; (2) a neutral agent selection methodology has been agreed; (3) a valuation approach has been agreed; (4) the temporary order or decree terms addressing the sale are clear and complete; and (5) the property is in a condition that can be listed without significant disputes over required improvements. Sellers who are not yet ready typically need attorney coordination before any listing step — attempting to list before these conditions are met creates the dual-principal conflicts that derail most contested divorce sales.

Buyout Spouse Readiness: What Makes You Ready

A buyout spouse is ready to proceed when: (1) the qualification assessment has been completed and the refinance loan amount is achievable on single income; (2) the buyout amount has been agreed or a neutral valuation methodology has been established; (3) the refinance timeline is compatible with the decree or settlement terms; (4) any alimony or child support being relied on for qualification has been received for at least 12 months; and (5) the quitclaim deed transfer and mortgage removal are understood as a simultaneous process. The most critical condition: qualification assessment BEFORE settlement commitment.

Purchasing Spouse Readiness: What Makes You Ready

A purchasing spouse is ready to begin a property search when: (1) the divorce is final (or a settlement agreement is signed) and the financial picture is clear; (2) the qualification assessment is complete; (3) if relying on alimony or child support income, 12 months of documented consistent receipt is achieved; (4) if credit was damaged during divorce, the recovery timeline has been mapped; and (5) the custody geography constraint is identified and the search area is geographically defined. The readiness assessment prevents the most common post-divorce purchase mistake: beginning the property search before the qualification picture is clear.

What Makes the OLH Assessment Different From Talking to an Agent

When a divorcing person contacts a real estate agent directly, the agent’s first interest is obtaining the listing or buyer representation agreement.
