Concurrent Filing: The H-1B Holder's Advantage

One of the most valuable EB-5 features for Indian H-1B holders: concurrent filing. If a principal beneficiary is in the US on a valid non-immigrant visa (H-1B, L-1, O-1, F-1), they can file the I-526E petition and I-485 (adjustment of status) simultaneously. This allows them to receive employment authorization (EAD) and advance parole while the EB-5 green card processes, freeing them from H-1B dependency and H-1B lottery risk. Concurrent filing is not available for EB-2 or EB-3.

LRS Funding for EB-5

Indian nationals using EB-5 must transfer investment funds from India. The LRS $250,000 annual limit per individual applies to offshore investments from India. An $800,000 EB-5 investment typically requires multiple family members' LRS allowances over multiple years, or use of offshore funds already outside India. EB-5 and US Property: What Changes After the Green Card

Once an Indian national receives conditional permanent residence through EB-5: (1) They can buy US property as a permanent resident, not a foreign national. (2) FIRPTA withholding no longer applies when they sell (they are not a foreign person). (3) The $60,000 estate tax exemption no longer applies; full $13.61M exemption available. (4) Standard US mortgage programs are available without the foreign national premium. The green card changes the entire financial profile of US property ownership.
