Disney World Area Airbnb Rules — What’s Legal, What’s Not

The Two Layers of Disney World Area Airbnb Rules

Short-term rental legality near Disney World operates on two independent layers: the county regulatory framework (Orange or Osceola County) and the HOA governing documents for the specific community. Both must permit STR for a property to legally operate as an Airbnb or VRBO vacation rental. A property in a county that permits STR but in an HOA that restricts it cannot legally be rented short-term. A property in an STR-authorised HOA in a county with restrictive STR rules has the same problem from the other direction. The due diligence process for any STR purchase must confirm both layers independently.

Orange County vs Osceola County STR Rules

Osceola County (Kissimmee, Champions Gate, Reunion Resort, Storey Lake, Four Corners): Osceola County has Florida’s most STR-friendly regulatory environment. The county requires a Florida DBPR Vacation Rental Licence but has not imposed additional county-level STR restrictions beyond the state requirement. STR is legal in Osceola County in any community whose HOA permits it. DBPR inspection wait time: approximately 6–10 weeks.

Orange County (Dr. Phillips, Windermere, Bay Hill, Lake Buena Vista area): Orange County has more restrictive STR regulations in its unincorporated areas. The county requires registration in addition to the DBPR licence. Most Orange County residential communities are not STR-permitted under county zoning rules. The exceptions are specific resort zones and commercially-zoned vacation rental properties. Buyers targeting STR investment should generally focus on Osceola County communities rather than Orange County residential areas.

Disney World Communities: STR Permitted vs Not Permitted

✓ STR-Permitted Communities (Osceola County)

Champions Gate (South Village sections), Reunion Resort, Storey Lake, Windsor Hills, Emerald Island Resort, Solterra Resort, Veranda Palms, Magic Village Yards, Solara Resort, Legacy Condos at Davenport, Four Corners-area communities with HOA STR authorisation

✗ STR-Not-Permitted Communities

Celebration (HOA prohibits STR), Windermere (deed restriction), Dr. Phillips (HOA restriction), Bay Hill (HOA restriction), Horizon West primary residence communities, most Orange County residential neighbourhoods, Champions Gate North Village (restricted 2024)

HOA rules change. Confirm current STR authorisation directly with the HOA management company before purchase, not from online sources that may be outdated.

Getting a Florida Vacation Rental Licence: The DBPR Process

Every Disney World area vacation rental property must have a Florida Vacation Rental Licence from the DBPR before the first guest checks in. The process: (1) Apply online at the DBPR portal, providing property information, ownership documentation, and the $135–$185 application fee. (2) DBPR schedules a physical inspection of the property — this cannot be done until the property is complete and furnished, which means the licence cannot be obtained until after closing. (3) The inspection checks for safety requirements: smoke detectors, CO detectors, fire extinguishers, pool barrier fencing if applicable, and other Florida vacation rental safety standards. (4) After the inspection passes, the licence is issued — typically within 5–10 business days of the inspection. Plan for a 6–10 week gap in Osceola County between closing and licence issuance.

Talk to Ryan Brown Before You Buy an STR Near Disney World

Ryan Brown (FL BK3626873) has facilitated dozens of STR acquisition transactions in Osceola County Disney World resort communities. He knows which communities currently permit STR, which HOA sections were recently restricted, and what the current DBPR inspection timeline looks like. This knowledge prevents the most common Disney World STR purchase mistake: buying in an HOA section that restricted STR after the buyer’s due diligence was completed.

Deep Dive: Osceola County STR Rules

Osceola County is the most STR-friendly county in the Disney World area. The county's regulatory framework requires only the Florida DBPR Vacation Rental Licence — there is no additional county-level registration requirement beyond the state licence. This makes Osceola County's process simpler and faster than Orange County's framework for residential STR operation.

Key Osceola County STR facts: (1) DBPR inspection wait time: 6–10 weeks from application submission to inspection completion. (2) The licence must be renewed annually (approximately $135–$185 renewal fee). (3) The property must pass the DBPR inspection every time it changes ownership — a new buyer must obtain a new licence, not transfer the seller's licence. (4) Osceola County does not cap the number of STR licences issued — unlike some Florida municipalities that have implemented STR permit caps.

Understanding HOA-Level STR Rules

The HOA governing documents — specifically the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) — are the binding legal documents that control whether STR is permitted in any community. HOA boards can amend CC&Rs (with homeowner vote thresholds defined in the documents) to restrict STR in sections that previously permitted it. This is exactly what happened in Champions Gate's North Village in 2024.

The due diligence process: (1) Obtain the current CC&Rs from the HOA management company, not from the listing agent. (2) Confirm which specific HOA section (not just community) the property falls within. (3) Read the rental restriction provisions in the CC&Rs. (4) Ask the HOA management company directly: "Has there been any vote or pending amendment related to short-term rental restrictions in this section?" (5) Get the confirmation in writing before submitting an offer.

Registering on Airbnb and VRBO with a Florida Licence

Both Airbnb and VRBO require Florida Vacation Rental Licence numbers for properties listed in Florida. Airbnb and VRBO collect and remit Florida state sales tax (6%) and the applicable county tourist development tax (varies — Osceola County is 6%, Orange County is 6%) on behalf of hosts. The net effect: you receive the gross booking revenue minus the platform's service fee, and the platform handles the state/county tax remittance automatically.

What the platform does not handle: your local business tax receipt (if required by your municipality), your DBPR annual licence renewal, and your federal income tax reporting of rental income. Vacation rental income is reported on Schedule E of your federal tax return and is subject to self-employment tax considerations if you provide substantial services to guests.

Frequently Asked Questions

Can you Airbnb a house near Disney World?

Yes — in specifically STR-permitted communities. Not all Disney World area communities permit short-term rentals. Orange County and Osceola County both require short-term rental licences (DBPR vacation rental licence) for properties rented for fewer than 30 days. Within HOA communities, the HOA must also permit STR — and some HOA sections that previously permitted STR have restricted it. Confirm STR authorisation at both the county level and the HOA level before purchase.

What licence do I need to Airbnb near Disney World?

Florida requires a Vacation Rental Licence from the Department of Business and Professional Regulation (DBPR) for any property rented for periods of fewer than 30 consecutive days. The licence requires a DBPR inspection of the property. In Osceola County, the current DBPR inspection wait time is approximately 6–10 weeks. In Orange County, wait times are shorter. The licence fee is approximately $135–$185 per year depending on property type.

Which Disney World communities allow Airbnb?

STR-permitted Disney World area communities include Champions Gate (South Village sections), Reunion Resort, Storey Lake, Windsor Hills, Emerald Island Resort, Four Corners area communities, and other HOA communities with explicit STR authorisation in their governing documents. Communities that do NOT permit STR include Celebration, Windermere, Dr. Phillips, Bay Hill, and most primary residence communities in Orange County.

Does Champions Gate allow Airbnb?

Champions Gate allows STR in the South Village sections. The North Village passed STR restrictions in 2024. The Oasis Club section has historically been the strongest STR performer due to the waterpark amenity complex. Confirm the specific HOA section's STR status before submitting any offer — the community level authorisation does not guarantee section-level authorisation.
