Texas SB 17: Scope and Key Provisions

Texas SB 17 restricts entities and individuals from countries of concern (China, Russia, Iran, North Korea) from owning real property in Texas. Key differences from Florida SB 264: (1) Texas applies more broadly, not only to those domiciled in the restricted country. (2) Restrictions extend to agricultural land and land near critical infrastructure. (3) Penalty for violation: forced divestiture of property, more severe than Florida. (4) Both direct and indirect ownership through entities are covered.

Constitutional Challenge Status

Texas SB 17 is being challenged on constitutional grounds including Equal Protection, federal preemption, and Fair Housing Act claims. As of mid-2026, constitutional challenges are pending. The law is currently in effect. See: All US State Restrictions for Chinese Buyers.

While challenges proceed, Chinese nationals should obtain legal advice before any Texas property purchase. The risk of acquiring property in violation and facing forced divestiture is real while the law is in effect.

What Chinese Buyers Can Still Do in Texas

Not all Chinese nationals are restricted. Available paths: (1) US citizens of Chinese heritage are fully unrestricted. (2) Green card holders are unrestricted.
